INTERNAL REGULATIONS JAZZ IN THE PARK 2018

DEFINITIONS

The following terms have the meaning agreed below, herein, unless otherwise defined in the content of the document:

CONCERT ACCESS TICKETS: A document issued in hard or soft copy, certifying the access right to one or several of the ticket based concerts from the Jazz in the Park festival. The tickets are not named and have a unique identification number. The tickets can be purchased directly from the organizer or from the organizer’s authorized ticket distributors, as indicated in the specific website section.

NON-MANDATORY TICKET: A document issued in hard or soft copy, certifying a donation for the Jazz in the Park Fund. Non-mandatory tickets are not a ticket or an entrance fee and do not provide access to the festival’s paid entrance events. The donations through non-mandatory tickets can be provided directly to the organizers or its authorized collaborators and distributors, as indicated in the specific website section. All the revenues from the donations made through non-mandatory tickets go to the Jazz in the Park Fund.

THE JAZZ IN THE PARK BRACELET: A physical or virtual marking certifying the fact that the person wearing it has made a donation to the Jazz in the Park Fund. The Jazz in the Park bracelet entails the same rights and liabilities in relation to its owner as a non-mandatory ticket.

ACCESS BRACELET: A physical or virtual marking applied by the organizer to the buyers of access tickets to concerts and entailing rights and liabilities identical to those related to the concert access tickets. An access bracelet certifies exclusively the fact that the person wearing it is entitled to enter the paid entrance concerts of the festival.

CONCERTS WITH TICKET BASED ACCESS: the concerts, activities, programs with restricted admission for the public. Only people having a concert access ticket and an access bracelet are allowed to enter ticket based concerts.

FREE ACCESS CONCERTS: the concerts, activities, programs where the access of the public is not restricted through the purchasing and/or owning of a concert access ticket or a non-mandatory ticket.

ACCESS TICKET BUYER: an individual or legal entity purchasing access tickets to the festival’s concerts.

NON-MANDATORY TICKET BUYER/DONOR: individual or legal entity making a donation to the Jazz in the Park Fund.

FESTIVAL DURATION: the period of time between the beginning and end of the festival, as publicly communicated through the website www.jazzinthepark.ro.

DURATION OF THE TICKET BASED CONCERTS: the period of time between the beginning and end of the concerts, as publicly communicated through the website www.jazzinthepark.ro. The beginning of the concerts corresponds to the beginning of the validity term of the concert access tickets, and the end of the concert corresponds to the end of the validity of the concert access tickets.

FESTIVAL: all the concerts, actions, programs, shows and other paid or free services organized by Jazz in the Park for a certain period of time and in one or several clearly indicated venues.

VENUE: any of the venues/areas hosting festival related activities, as indicated in the specific website section.
ORGANIZER(S): individual or joint venture organizing and staging the Jazz in the Park festival, having exclusive rights on the festival. The Jazz in the Park festival is co-organized by Fapte Association (23, Unirii Street, ap. 54, Cluj Napoca, FIC 31425230) and the Association Beyond the Line Production (Al. Vlahuță Street, bl. LAMA A, ap. 25, Cluj Napoca, FIC RO 31425273).

COMMERCIAL PARTNER: individuals, legal entities or joint ventures performing an independent commercial activity, duly authorized, during the festival, based on a contractual relationship with one of the festival’s organizers.

PARTNER: individual, legal entity or joint venture collaborating with one of the organizers for the purpose of a cultural, commercial, promotional or any other type of activity mutually agreed, based on a contractual relationship, during the festival.

PARTICIPANȚS: all the people attending the festival, whether they are paying or non-paying participants, volunteers, representatives of the commercial partners, representatives of the suppliers, organization team or any other third party found, at a certain time, in a festival location, during its period.

PAYING PARTICIPANTS: buyers and users of concert access tickets and passes.

NON-PAYING PARTICIPANTS: participants to the free access concerts, whether or not they are also paying participants and/or buyers/donors of non-mandatory tickets.

UNAUTHORIZED PARTICIPANTS: persons attending a paid access concert during the festival, without having the valid right to enter, by buying a concert access ticket, including the people who have an access bracelet obtained through the illegal purchasing of a concert access ticket.

PARTICIPANTS IN THE JAZZ IN THE PARK FUND: individuals or legal entities filling out a project registration form for the Jazz in the Park Fund.

PARTICIPANTS TO THE JAZZ IN THE PARK COMPETITION: individuals or legal entities filling out a project registration form for the Jazz in the Park Competition.

PRODUCT: items and rights with monetary value which can be purchased from the organizers or the organizers’ commercial partners within the festival or in relation to the festival.
SERVICE: any service provided by or purchased from the organizers or the organizers’ commercial partners or related to them.

WEBSITE: the project’s website, namely www.jazzinthepark.ro
THIRD PARTIES: individuals/legal entities, other than the organizers, partners, commercial partners, participants, buyers, donors or visitors of the festival.

VISITORS: individuals/legal entities entitled to participate in the festival, other than buyers and participants.

REGISTERED VOLUNTEER: a person who fills out the volunteer registration form for the festival.

PARTICIPATING VOLUNTEER: individual over 16 years of age who, after filling out a valid registration form, was selected for participating as a volunteer to the Jazz in the Park festival.

GENERAL TERMS AND CONDITIONS
2.1. These regulations determine the terms and conditions related to the participation in the Jazz in the Park 2018 festival.
2.2. Through their participation in the festival, the participants, volunteers, collaborators and any third parties interacting directly or indirectly with the festival accept and agree with the terms and conditions herein.
2.3. The content of these regulations is the property of the Jazz in the Park festival organizers, namely the Fapte Association and the Association Beyond the Line Production.
2.4. The festival Jazz in the Park 2018 is managed by Fapte Association as organizer and the Association Beyond the Line Production as main partner. The Fapte Association is a non-profit legal entity, with registered office in Cluj Napoca, 23, Unirii Street, ap. 54, Cluj County, having the FIC 31425230. The Association Beyond the Line Production is a non-profit legal entity, with registered office in Cluj Napoca, Al. Vlahuță Street, bl. LAMA A, ap. 25, Cluj County, having the FIC RO31425273.

FESTIVAL PERIOD AND LOCATION
3.1. The Jazz in the Park 2018 festival will take place during the period June 21st – July 1st, 2018 according to the following schedule:

Cluj Napoca, courtyard of the Art Museum, 30, Unirii Square, period June 22nd – June 27th, 2018, opening hours 7 PM – 11 PM
Cluj Napoca, Grigorescu Beach, 124, 1 Decembrie 1918 Blvd., period June 22nd – June 24th, opening hours 12 AM – 11 PM
Cluj Napoca, 19, Platanilor Street, period June 26th, 2018, 5 PM – 10 PM
Cluj Napoca, the Simion Bărnuțiu Central Park, 14, George Coșbuc Street, period June 28th – July 1st, 2018, 12 AM – 12 PM

ACCESS TO THE FESTIVAL
4.1. By attending the events organized by Jazz in the Park or by accessing the Jazz in the Park communication channels, particularly the website www.jazzinthepark.ro, the participants and users confirm that they have read, understood and agreed to these regulations. The regulations are available on the project’s website www.jazzinthepark.ro, and in the informative points within the festival, at the access points from the ticket based section, and upon the express request of any participant.
4.2. In order to ensure the order and safety of the festival events, the organizers reserve the right to enforce a restriction regarding the objects and devices that can be brought in the festival’s perimeter. The following objects are prohibited on the festival’s perimeter:
Pyrotechnical items.
Knives, weapons or other blunt objects.
Drugs.
Flammable or explosive materials.
Any type of objects tat could harm the other participants.
4.3. Through the free access to the Jazz in the Park 2018 events, the participants take responsibility for the objects they have and take into the festival’s perimeter, as the organizers do not have the logistic possibility to check the participants, due to the free access structure of the event. The organizers reserve the right to check the participants, randomly or due to suspicions identified by the organizing team and/or security team and to confiscate any identified prohibited items. In the case of incidents due to the possession of one of the aforementioned objects, their owners shall take full responsibility for them.

4.4. ACCESS TO THE FREE SECTION
The access to the following festival locations is free of charge, which means that the organizers do not charge a participation fee:
Cluj-Napoca, Grigorescu Beach, 124, 1 Decembrie 1918 Blvd., period June 22nd – June 24th, opening hours 12 AM – 11 PM
Cluj-Napoca, 19, Platanilor Street, period June 26th, 2018, 5 PM – 10 PM
Cluj-Napoca, the Simion Bărnuțiu Central Park, 14, George Coșbuc Street, period June 28th – July 1st, 2018, Thursday/Friday – 6 PM – 12 PM, Saturday/Sunday – 12 AM – 12 PM.
The access to the aforementioned areas shall commence at the time communicated by the organizer on the festival’s official website or through press releases.

4.5. ACCESS TO THE TICKET BASED SECTION
The access to the following festival venues is subject to the possession of a valid festival access ticket or pass purchased from one of the authorized centers, an invite or accreditation, regardless of the age of the spectators:

The access to the aforementioned areas shall commence at the time communicated by the organizer on the festival’s official website or through press releases. The beginning of the concerts corresponds to the beginning of the validity term of the concert access tickets, and the end of the concert corresponds to the end of the validity of the concert access tickets.
Minors accompanied by adults may attend the ticket based concerts only if they have a valid ticket or pass; this rule applies to all ages: 0-18 years.
The participation in the festival shall be performed using one of the following types of tickets:
Concert access ticket: grants access to one nominal event in the festival.
Festival pass: grants access to the entire ticket based section of the festival.
Concert invite: grants access to one nominal event in the festival.
Pass invite: grants access to the entire ticket based section of the festival.
Concert press accreditation: grants access to one nominal event in the festival.
Press pass accreditation: grants access to the entire ticket based section of the festival.
For the purposes of these regulations, the access ticket/pass is a document issued in hard or soft copy, certifying the access right to one or several of the ticket based concerts from the Jazz in the Park festival. The tickets are not named and have a unique identification number. The tickets can be purchased directly from the organizer or from the organizer’s authorized ticket distributors, as indicated in the specific section of the website www.jazzinthepark.ro.
One ticket/pass is valid for one person. Concert access tickets are valid for one festival admission, while access passes allow one admission to each ticket based event in the festival.
The organizers shall not be liable for the loss, theft or damage of the purchased tickets, which shall be the responsibility of the participants/buyers.
Reselling the tickets/passes/invites/accreditations is prohibited.
When entering ticket based concerts, the tickets shall not be exchanged for access bracelets.
The participants shall keep the bracelets throughout the festival’s ticket section period. The organizers shall check the bracelets at every event entrance and every ticket based event. The participants shall be solely liable for the damage, loss or theft of the bracelet.
4.6. The non-mandatory tickets, as defined in the specific section herein, shall not grant their holders access rights to the festival’s ticket based section.

RIGHTS AND LIABILITIES OF THE PARTICIPANTS
The participants, volunteers, partners and third parties are entitled to participate in all festival related activities for which they purchased a valid access ticket or for which they have free access, according to the terms defined above.
The participants, volunteers, partners and third parties shall comply with these regulations throughout the festival period and in all festival venues.
The participants, volunteers, partners and third parties shall not use festival venues for any activities that are illegal or jeopardize in any way the safety of the other festival participants.
The participants, volunteers, partners and third parties shall not distribute, amend or copy, share, display, reuse, reproduce, publish, create derivatives, transfer, sell or use the content of the festival or these regulations without the prior written consent of the organizers.
The participants, volunteers, partners and third parties shall not used the festival venues or any derivatives for advertising or commercial purposes, without the prior written consent of the organizer.
The participants, volunteers, partners and third parties shall immediately notify the representatives of the organizer or the security team regarding any situation that they have strong reasons to report as a hazard for the safety of the other participants, during and in the perimeter of the festival.
The participants, volunteers, partners and third parties shall cooperate with the organizers and the representatives of the health and safety services, the relevant authorities, the volunteers, in order to ensure the proper performance of the festival, to prevent situations that could jeopardize the safety of the participants or to remediate such situations as soon as possible.
The participants, volunteers, partners and third parties shall observe the legislation in force on smoking in closed areas; smoking is prohibited in all the closed areas of the festival. The closed areas of the festival include, without limitation: The Casino building, the UAD building, the Hungarian Opera and any other closed area.

RIGHTS AND LIABILITIES OF THE ORGANIZERS
The organizers are entitled to amend, supplement, withdraw, temporary or permanently, these regulations, with or without the prior notification of the users, potential users or any other third party. Any amendment shall become effective upon their publishing on the website www.jazinthepark.ro
The organizers may investigate any action suspected of violating these regulations and may issue warnings, suspend, restrict or divide the access to the festival for any participant, volunteer, partner or any third party present on festival premises, during the festival period.
The organizers shall not be responsible for any objects brought into the festival’s perimeter by participants, volunteers, partners and third parties, during the festival period.
The organizers reserve the right to check the participants, randomly or due to suspicions identified by the organizing team and/or security team and to confiscate any identified prohibited items. In the case of incidents due to the possession of one of the aforementioned objects, their owners shall take full responsibility for them.
The organizers shall not be responsible for the participants’ goods, for their loss, damage or theft.
The organizers shall not be liable for the loss, theft or damage of the purchased tickets, which shall be the responsibility of the participants/buyers.
The organizers shall not be responsible for the content provided by the festival’s partners, during the festival perimeter and period.

RULES OF CONDUCT
6.1. Festival participants are encouraged to display a behavior that is adequate to public events.
6.2. Festival participants shall refrain from any actions, statements or behaviors which have the potential of jeopardizing the life, health or physical integrity of the other festival participants.
6.3. Any form of selling or advertising in the festival’s perimeter, without the prior written permission of the organizers, shall be prohibited.
6.4. Any kind of demonstration or manifestation, unrelated to the festival and its organizers and which does not have the prior written approval of the organizers, shall be prohibited.
6.5. The selling of alcoholic beverages shall be performed in the conditions of the law; such beverages shall not be offered to minors under the age of 18 and/or to inebriated persons, by the organizer’s commercial partners, during the festival.
6.6. The use of substances classified by the applicable law as drugs is prohibited on the festival’s perimeter and shall be sanctioned according to the law.
6.7. The participants acknowledge and expressly agree that, by virtue of their participation to the festival, they shall fully cooperate with the organizers, the organizers’ commercial partners, the volunteer, technical team, the representatives of the security and first aid services, and any other public or private authorities involved in the organization of the festival, and shall observe their instructions during the festival, in the case of emergencies or any other situations requiring it.
6.8. The participants undertake to pay for all the products and services they consume and purchase during the festival period and perimeter. The participants shall pay the products and services subject to payment by using the payment methods provided by the organizers or their commercial partners.

7.1. PERSONAL DATA PROCESSING
7.1. The festival organizers may process the following personal data of the participants, volunteers, partners and third parties, interacting with the festival:
Contact details and information, including, without limitation: surname, first name, position or job, home address and mail address, contact details of the employer, phone number, e-mail address and any other similar data.
Additional data and information processed according to the law, for entering or performing an agreement, data and information communicated voluntarily by the data subject and including, without limitation: personal identification data (PIN, ID card series and number), banking details for payment purposes, data regarding the employer or legal entity they represent and any other such data.
Other personal data required for the performance of the agreements concluded between the parties, for the notification of users and any other data proving relevant for the activity performed by the organizer and in the legitimate interest of the data controller.
Any other information and data collected from public sources.
7.2. The processing of personal data classified as special data, according to art. 9 of the Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, shall be performed as follows:
Based on the prior written consent of the data subject.
Based on the fair proof of the consent provided by a third party, communicating such data based on a contractual agreement.
Based on a legal obligation of processing such data categories.
Based on an obligation to defend a legitimate right.
7.3. The organizers may collect the users’ personal data, in the following situations, including, without limitation:
When the users, individuals or legal entities, engage in contractual relationships with the organizers.
When the users, the legal entities representing them, communicate voluntarily, due to any reason, their personal data.
When you use the website www.jazzinthepark.ro and expressly agree to the Terms and Conditions for the use of the website.
When the users attend an event/concert organized during the festival, involving the provision of personal data, e.g.: workshops, conferences, ticket based concerts, etc.
7.4. Organizers may collect personal data regarding the participants, volunteers, partners, third parties and users from a third party, including, without limitation, the legal entities they represent, the legal entities with which they have contractual relationships, government agencies, credit offices, ticket selling agencies, public archives, other information providers with which the organizers have concluded agreements which also include the sharing of such data.
7.5. The processing of the users’ personal data shall be performed based on the following legal grounds:
The processing is required for the performance of an agreement or for concluding an agreement between the participant and the organizers or the legal entity they represent and the organizers.
The processing is required for complying with a legal obligation.
The processing is performed based on a prior written consent.
The processing is required for the legitimate interests of the organizers, unless the interests, rights and fundamental freedoms of the individuals prevail.
7.6. The organizer collects the aforementioned personal data for the following purposes:
The compliance, by the organizers, with the legal obligations, including, without limitation: obligations on keeping records, obligations on reporting to public authorities, obligations arising from the conclusion or performance of agreements between individuals and organizers.
Promoting the festival, exclusively in the interest of the organizers.
Organizing workshops, classes, seminars and other such events.
For the issuing/processing of any financial and accounting documents, concluding agreements, compiling participant lists and any other data required according to the law, for the festival related activities.
For statistical purposes, exclusively in the interest of the organizers, for improving the services and notifications to the participants, volunteers, etc.
For safety and the management of event access, the registered office and working points, the online systems belonging to the user, preventing and detecting online and event security threats, fraud or other criminal offenses, according to the case.
For monitoring and assessing the lawfulness and compliance with the legal provisions, standards and internal regulations of the organizers.
Any other purposes, related to and/or auxiliary to any of the aforementioned purposes, or any other purposes for which your personal data were explicitly provided.
The communication with the participants, users and volunteers who provided their express prior consent to receiving constant information regarding the organizers’ events/festival/services/products and projects.
Performing surveys, marketing campaigns, raffles, competitions and other similar events, with the users and participants who have provided their express prior consent.
7.7. The organizers reserve the right to share the obtained personal data in the following situations:
The confidential supply of data to third parties, for the purpose of obtaining your feedback regarding the provision of services by them, measuring the performance and improving the services of the organizers.
The supply of personal data to public authorities and authorized companies providing services such as inspections for combatting money laundering, inspections for combatting fiscal fraud, mitigating credit risks and any other situations involving the prevention of fraud and crime, other regulatory, control authorities, etc.
Monitoring the use of the website in order to contribute to the development of the website and the organizer’s services.
With the organizer’s service providers, in relation to the festival, for the processing of personal data, for the purposes allowed by the legislation in force, on behalf of the organizer, and only according to the terms and conditions enforced by the organizer.
7.8. The organizer undertakes to implement proper organizational measures, in order to safeguard the privacy and safety of the obtained personal data, according to the internal data processing policy.
7.9. The individuals whose personal data was processed according to the aforementioned provisions may withdraw their consent regarding the processing of such data. The withdrawal of the consent shall not affect the lawfulness of the processing, prior to such withdrawal.
7.10. In order to withdraw their consent, data subjects may submit an explicit, dated and signed letter, to the e-mail address salut@fapte.org or postal services, to the address Asociația Fapte, str. Unirii, nr. 23, ap. 54, Cluj Napoca.
7.11. In case of a withdrawal of the consent, the personal data of the applicants shall no longer be processed, and the organizers shall take measures, in order to delete the personal records from the related databases. Unless the processing is strictly required by the activity, ad is based on legitimate grounds, according to the legal provisions in force. In this case, the organizers shall notify the applicants regarding the exceptions, according to the law.
7.12. If the personal data processed on grounds of these regulations and the legislation in force are amended or their holders find out that the data we have in relation to them are inaccurate, they may request the amendment of such data, by sending a dated and signed letter to the e-mail address salut@fapte.org or postal services, to the address Asociația Fapte, str. Unirii, nr. 23, ap. 54, Cluj Napoca.
7.13. The personal data processed by the organizer shall be deleted or eliminated as soon as they are no longer reasonably required for the purposes allowed by the legislation in force or when their holders withdraw their consent, according to the provisions of art. 6.10. – 6.12.
7.14. All the individuals that are subjects of the personal data held by the organizers shall be entitled to:
Ask what information does the association hold regarding their person and why and request a copy of such information.
Ask how they may access those data.
Receive information about how to keep such data updated.
Receive information about how the association complies with its obligations regarding data protection.
Request the amendment and updating of the data held by the organizers.
Withdraw their consent regarding the processing of data, subject to art. 6.10. – 6.12. and the legislation
Request the restriction of processing, if the processing is unlawful, unfair, incorrect, appealed or no longer required.
If a person contacts the organizers, requesting such information, this is called a data subject access request. Subject access requests shall be submitted via e-mail, to the data controller, to salut@fapte.org.
Individuals shall not be charged for requesting access to such data. The data controller shall attempt to send the relevant data within 14 days from receiving the data access request. The data controller shall always attempt to check the identity of any person submitting a data access request, prior to sending any information.
If the person contacting the organizers is not satisfied with the answer received from them, he/she may address to the National Supervisory Authority for Personal Data Processing – having its office in 28 – 39, Gheorghe Magheru Blvd., Bucharest.

INTELLECTUAL PROPERTY RIGHTS
8.1. The content, activities, artistic and organizational concepts, internal procedures and any other similar items (information, data, images, texts, symbols, graphics, web design elements, software and other similar items) are the property of the organizers and are protected by Law no. 8/1996 regarding the protection of copyrights.
8.1. The use of any of the aforementioned items or any other similar items which could be related to copyrights, without obtaining the prior written consent of the organizers, shall be sanctioned according to the law.
8.3. The full or partial reproduction, amendment, transfer, sharing, republishing, copying, partially or fully, of the event content, shall not be allowed without the prior written consent of the organizers.
8.4. Personal data are not subject to the provisions above and are approached separately herein.
THE PHOTO – VIDEO RECORDING OF THE FESTIVAL
9.1. The organizer reserves the exclusive right on the photo-video images from the entire festival.

9.2. The participants hereby acknowledge and agree that the organizers, commercial partners, authorized suppliers of the organizer, press members and any other third parties authorized by the organizers may perform audio, video and photo recordings of the festival.
9.3. The organizer may use photo and video images, taken both by their own employees, service providers, commercial partners and other authorized third parties, in various materials compiled for the festival.
9.4. By virtue of their participation to the festival, the participants grant the organizer and any other authorized entity the express permission to record and publish their image, look and actions during the festival, on the festival perimeter.
9.5. The organizers and the authorized third parties have the unrestricted right to use, copy, publish, make public, broadcast and share, particularly for the purpose of promoting the festival, but not only, the recordings, images and photos taken with the festival participants, without having to pay any remuneration to the participants in this regard.
9.6. The organizers reserve the right to record, directly or through the authorized third parties, the festival, concerts, programs and activities, to copy, share, broadcast or make public in any way and through any data transmission means or electronic means, including for promoting the festival.
9.7. Within the extent of the legal provisions, the participants shall not be entitled to make any financial or other claims against the organizers, in relation to the photo – video recordings and their publication, according to the provisions herein.
9.8. The participants shall be entitled to make audio/photo/video recordings of the festival, to be used for personal purposes. The participants shall not be entitled to sell the images/photo-video recordings from the festival without the prior written consent of the organizers.

OTHER INFORMATION
10.1. Suggestions and complaints
10.1.1. The participants, volunteers, partners and third parties may submit at any time suggestions or complaints to the organizers, through an e-mail to the address salut@fapte.org.
10.2. Lost items
10.2.1. The lost and found items can be handed over to the festival’s Info Point, where the owners shall be able to retrieve them within 48 hours, but no later than 12.00 o’clock, during the day following the closing of the festival.

10.2.2. The organizers shall not be responsible for the participants’ goods, for their loss, damage or theft.
10.3. The reusable cup system
10.3.1. During the festival, the organizers shall use a reusable cup system for the sale of beer, in all of their own sale points, the sale points of their commercial partners or other third parties authorized to sell alcoholic beverages in the festival perimeter and during the festival period.
10.3.2. The cups shall circulate subject to a deposit system, between the commercial partners of the organizers and the participants.
10.3.3. The deposit charged for the reusable cups is Lei 3/pc. The deposit shall be distinctively indicated by the commercial partners on the receipt, according to the provisions of art. 286 para. (4) letter d) from the Fiscal Code.
10.3.4. The reimbursement of the money deposit shall be performed only in the location specifically provided by the commercial partners in the festival perimeter. The reimbursed deposit is Lei 3/cup. The reimbursement of the deposit shall be performed without a supporting fiscal document, according to the provisions of art. 286 para. (4) letter d) from the Fiscal Code.
10.3.5. The cups shall not be returned to the bars owned by the organizer or its commercial partners.
10.3.6. The maximum number of cups that a person may return is 5.
10.3.7. Once purchased, a reusable cup may be used for an unlimited number of times and in the festival perimeter, without any other deposit.
10.3.7. When purchasing a drink, of the participant already has a reusable cup, it shall be changed with a clean cup, in any of the alcoholic beverage sale points within the festival, managed by the organizers or their commercial partners.
10.3.8. The organizers, their commercial partners or any other third parties authorized to sell alcoholic beverages in reusable cups shall not take any responsibility for the theft of the reusable cups in the possession of the participants.
10.3.9. The participants are encouraged not to throw away their reusable cups in the waste bins, even if they no longer need them and they do not wish to recover the deposit paid for them. In this case, the participants are encouraged to hand over the cups to any member of the organizing team, the volunteers or the staff of the organizer’s commercial partners.

LITIGATIONS
11.1. These regulations, along with any litigation related to or arising from its clauses or the participation in the event, shall be settled amicably by the participants, partners, third parties and organizers.
11.2. If this is not possible, the settlement of conflicts shall be subject to the competent jurisdiction of the Romanian courts of law from the organizers’ registered office.
11.3. By attending the events organized by Jazz in the Park or by accessing the Jazz in the Park communication channels, particularly the website www.jazzinthepark.ro, the users confirm that they have read, understood and agreed to these regulations.

LIMITATION OF LIABILITY
12.1. The users hereby acknowledge and agree that they shall attend Jazz in the Park 2018 at their own risk. The organizers, Fapte Association, the Association Beyond the Line Production, the collaborators, partners and commercial partners of the organizers shall not be held liable for direct or consequential damages arising from the access in the festival perimeter or the use of the services provided in the festival perimeter, including, without imitation: material damages, the loss of data or software, financial damages, etc.
12.2. The users hereby acknowledge and agree that the content of the festival is presented without any warranty of any kind.
12.3. The information regarding the events, activities, concerts, artistic performances, organized, hosted or promoted by the organizer are exclusively provided for information purposes and shall not be construed as a contractual offer of the services provided by the organizers.
12.4. On a best effort basis, the organizers shall keep the information provided on the website, on the social media channels, in the press and any other public information means, accurate and updated. If any potential errors are notified, the organizers shall attempt to correct them as soon as possible.
